1) About the Service (No Emergency Service)

SafetySense provides AI‑assisted monitoring to help detect potential falls and other events in a home or facility. The Service is not a substitute for 911 or emergency services, medical advice, diagnosis, or treatment. In an emergency, call 911 or your local emergency number. Alerts are transmitted via third‑party networks and may be delayed or not received.

2) Eligibility & Accounts

You must be legally able to enter these Terms and use the Service in compliance with applicable laws. You are responsible for maintaining accurate account information and for all activity under your account and devices. If you create profiles for others (e.g., a loved one), you represent you are authorized to do so and to receive related notifications.

3) Hardware, Software & Updates

Some features require compatible devices (e.g., IP cameras, a local computer). You authorize SafetySense to provide software updates that may install automatically. You are responsible for internet connectivity, power, local network configuration, and recommended device placement.

4) SMS Program Terms

We send transactional texts for safety alerts (e.g., possible fall), device status (offline/online), account/security (one‑time passcodes), onboarding, and test alerts. Message frequency is event‑driven and low volume. Msg & data rates may apply.

4.1 Opt‑In

Recipients opt in during setup or via our portal. We may require a double opt‑in (reply YES) to activate alerts.

4.2 Opt‑Out & Help

Reply STOP to opt out at any time. Reply HELP for help or contact support using the details below. After opting out, you may receive a final confirmation text.

4.3 Delivery & Carriers

Message delivery is provided by carriers and messaging partners; carriers are not liable for delayed or undelivered messages. Connectivity, device settings, filtering, or outages may impact delivery.

4.4 Supported Regions & Numbers

We use US local (10DLC) and/or toll‑free numbers for the United States (and Canada for toll‑free, once verified). Some features may be unavailable with certain carriers.

5) Privacy & Data

Your privacy matters. Our Privacy Policy explains what we collect, how we use it, and your choices. By using the Service, you agree to the Privacy Policy. Video analysis is designed for local processing where possible.

6) Acceptable Use

You may not misuse the Service, interfere with its operation, violate others’ rights or privacy, or use it for unlawful purposes. You will comply with applicable notification and recording laws when using cameras and audio/video features.

7) Fees & Billing

Some features require paid subscriptions or numbers. Taxes and government fees may apply. We may suspend or cancel the Service for non‑payment. You can cancel future billing in your account settings or by contacting us.

8) Warranties & Disclaimers

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory (including merchantability, fitness for a particular purpose, and non‑infringement). We do not guarantee detection, prevention, or notification of any particular event.

9) Limitation of Liability

To the maximum extent permitted by law, SafetySense and its affiliates, officers, employees, and partners will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amounts you paid for the Service during the 12 months before the event giving rise to the claim.

10) Indemnification

You agree to indemnify and hold SafetySense and its affiliates harmless from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your misuse of the Service or violation of these Terms or applicable law.

11) Suspension & Termination

We may suspend or terminate your access if we believe you violated these Terms or if required by law. You may stop using the Service at any time. Certain sections of these Terms will survive termination.

12) Changes to the Service/Terms

We may modify the Service or these Terms to improve functionality, address security, or comply with law. If changes are material, we will provide reasonable notice (e.g., via the app/site or SMS). Continued use after the effective date means you accept the changes.

13) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to conflict‑of‑law rules. Any dispute will be resolved by binding arbitration on an individual basis under the rules of the American Arbitration Association in Boston, MA, except that you or SafetySense may seek injunctive relief in court for misuse of intellectual property or violation of privacy/security obligations. Class actions are not permitted. You may opt out of arbitration within 30 days of first acceptance by emailing us at the address below.
